1. About these terms and our business
These terms govern the use of movingmodesty.com and purchases from Moving Modesty, a trading name of Maximin Label (Pty) Ltd, registration number 2023/648009/07, with its registered address at 13 Ladies Mile Road Extension, Constantia, Cape Town, Western Cape, 7806, South Africa. They apply together with our Privacy Policy, Refund and Cancellation Policy, and Shipping and Delivery Policy. These terms are governed by South African law, including the Consumer Protection Act, the Electronic Communications and Transactions Act and POPIA. Nothing in these terms limits rights that cannot lawfully be limited.
2. Eligibility, accounts and accurate information
You must be at least 18 years old, or purchase with the involvement and consent of a parent or legal guardian. You must provide true, complete and current account, contact, delivery and payment information. You are responsible for keeping account credentials confidential. We may refuse, suspend or cancel activity where we reasonably suspect fraud, misuse, unlawful activity or a breach of these terms.
3. Products, prices, VAT and availability
Product descriptions, images and specifications are provided in good faith. Screen, lighting and photography settings may cause slight colour differences. Products and colours remain subject to availability. Prices are displayed in South African rand. Maximin Label (Pty) Ltd is CIPC-registered but is not currently registered for VAT, so VAT is not added as a separate charge. We may correct genuine product or pricing errors and will contact you before proceeding if a correction affects an order.
4. Orders, payment and contract formation
Placing an order is an offer to buy the selected products. A binding sale is formed only when payment has been successfully authorised and we send an order confirmation. Payments are processed through PayFast; Moving Modesty does not collect or store your full card number, expiry date or CVV. We may reasonably decline or cancel an order because of unavailable stock, an obvious error, incomplete information, suspected fraud or non-compliance. Any amount already paid for a cancelled order will be refunded.
5. Delivery, shipping and collection
We deliver nationwide within South Africa. Orders are prepared for dispatch within two business days. Major metropolitan and serviced areas should allow up to approximately five business days after dispatch, while outlying areas should allow approximately five to seven business days. Delivery fees are calculated at checkout and nationwide delivery is free on product subtotals of R1,200 or more. Local collection is available by prior arrangement only, with the address provided after confirmation. 6. Returns, exchanges and cancellations
Online customers have a statutory seven-day cooling-off right where applicable. From day eight to day ten after delivery, eligible unworn and unwashed items with original tags and packaging may be exchanged for another size, colour or product, or for store credit, subject to stock. Separate statutory remedies apply to faulty, unsafe, damaged or incorrectly supplied goods. Contact movingmodesty@gmail.com with your order number before returning an item. 7. Website use, content and intellectual property
The Moving Modesty name, logo, Faith in Function tagline, FlexAir Mesh name, product names, text, photography, video, graphics and website design are owned by or licensed to Maximin Label (Pty) Ltd and protected by applicable intellectual-property law. You may not copy, reproduce, distribute, resell or commercially exploit this content without prior written consent. You must not use the website unlawfully, attempt unauthorised access or interfere with its operation. We may change, suspend or withdraw parts of the website without notice.
8. Liability, indemnity and external platforms
To the maximum extent permitted by law, Moving Modesty is not liable for indirect, special or consequential loss arising from use of the website or purchase of products. Nothing excludes liability for death or personal injury caused by negligence, liability for unsafe, hazardous or defective goods under section 61 of the Consumer Protection Act, or any liability that cannot lawfully be limited. You remain responsible for loss arising from your unlawful misuse of the website or breach of these terms. Links to Instagram, WhatsApp and other third-party platforms are governed by those platforms’ own terms and practices.
9. Privacy, complaints and governing law
Personal information is handled in accordance with our Privacy Policy and POPIA. Please send questions or complaints first to movingmodesty@gmail.com or +27 76 651 4548 so we can try to resolve them promptly. Unresolved consumer complaints may be referred to the Consumer Goods and Services Ombud or National Consumer Commission where applicable. These terms are governed by South African law and do not prevent either party from approaching a court or tribunal with jurisdiction.
10. Changes, general provisions and contact
We may update these terms to reflect changes in our business, services or the law, and will show the revised date on this page. If one provision is invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. We are not liable for delay caused by circumstances beyond our reasonable control, including load-shedding and courier disruption.
